Founding Members

Monthly Dues: Monthly dues for the membership remain at the Founding Member Rate for the agreed upon 5-year term. Monthly dues, along with authorized member charges will be collected electronically. All members must provide Electronic Funds Transfer information on this agreement.

Term: The initial term of this membership agreement is for 12 months, after which this agreement will automatically renew on a month-to-month basis until terminated in writing or in person by the member or the club.

House Account Agreement: House Account privileges allow for payment of purchases made at the club to be included in your regular monthly dues billing cycle as defined in the authorization agreement below.

Payment Authorization Agreement
I/We (member) authorize The Mine to effect payment for monthly dues and approved member charges for the duration of my/our membership through electronic funds transfer (bank draft or credit card). I understand that this payment arrangement will not be terminated by the Club until I/We give the Club 10 days written notice in advance of member’s next billing date via certified mail or in person of my/our intent to terminate the membership according to our cancellation policies described in this contract.

Terms of Membership
Member agrees to pay The Mine, fees and dues set forth in this agreement in consideration of the membership privileges set forth in the agreement and any addendums. Member agrees to pay membership fee. Member and Club agree that the $50 down and membership fee is a non-refundable fee subject to the terms of this agreement except as provided in the notice of consumer rights herein. Member agrees to pay the first and final amounts regardless of whether member uses Club facilities.

This agreement together with the policies and procedures of the Club and any addendums attached hereto represent the complete understanding between the Member and the Club. No representation, written or oral, other than those contained within this agreement is authorized by or binding upon the Club.

Notice of Consumer Rights
We are not required to carry a performance bond under the Maryland Health Club Services law because we do not accept more than 3 months of payment in advance or charge initiation fees over $200.

If The Mine is closed for a month or more, you are entitled to your choice of either an extension of the contract or a prorated refund. If the closing is not the fault of the business, we (the club) are entitled to choose.

You have the right to cancel this contract within three business days after receipt of a copy of the agreement. Cancellation must be in writing and delivered in person or by certified or registered mail. If you cancel, you are entitled to a full refund of all monies paid.

Conditions
Buyer’s right to Cancel or Terminate:
All cancellation requests must be submitted in writing to Club Management 10 days in advance of member’s next billing date via certified mail or delivered in person. Cancellation requests via e-mail are not acceptable. Notice for payment authorization termination must be given 10 days in advance of next billing date. Your membership fee will be forfeited upon cancellation except as provided in the Notice of Consumer Rights herein. All outstanding dues and service fees must be paid upon cancellation. An early termination fee of $150 will be assessed on any contract cancellations except for month-to month members or as provided in the Notice of Consumer Rights herein. Cancellation terms:
Member in Contract: If a member in contract term cancels their contract term for any reason, an early termination fee of $150 will apply. The Mine shall have the right to charge the termination fee to the Member’s billing account being used for monthly dues payments.

Month to Month members (after 1 year commitment of contract) may voluntarily terminate membership at any time for any reason by 1) notifying the club in writing 10 days in advance of the member’s next billing date via certified mail or delivered in person and 2) paying all current charges prior to termination.

Reversion Clause: if the principal member cancels his/her membership, the dues rate of the non-minor, second member on the membership will revert to the dues rate of the primary member. The rates of any other secondary members on the agreement may be subject to change.

Conditions:

Medical Freeze: Members must submit a written request for medical freeze along with a note from an M.D. and your membership I.D. to the Club Management in person or via certified mail prior to the start of the freeze. During the term of the freeze, you will not be billed, and you will not be able to use the facility. The billing freeze is only available if you cannot physically receive services because of a physical disability for a period in excess of (1) month. Written verification of your physical condition from the doctor is required. You are responsible for reactivating your membership by providing written notice to the club manager via certified mail or in person. All freezes must be processed and approved by Club management prior to freezing. If proper documentation is not provided by the member and management approval is not given prior to the freeze and upon reactivation, the member account will be considered delinquent and will be subject to payment policy terms and fees described in this contract. Upon reactivation normal monthly billing will continue at the contractual rate. A freeze due to disability extends your membership by the term of the freeze as provided in the Notice of Consumer Rights herein. This contractual right does not alter, limit or supersede your statutory rights as provided by the Notice of Consumer Rights herein.

Freezes for other reasons other than medical: will be considered on a case-by-case basis, must be in writing before the start of the freeze and must be approved by Management. During the term of the freeze, you will be billed one third of your membership. All freezes must be processed and approved by Club management prior to freezing. You are responsible for reactivation of your membership by providing either written notice to the club manager via certified mail or in person. Upon reactivation normal monthly billing will continue at contractual rate. This contractual right does not alter, limit or supersede your statutory rights as provided in the Notice of Consumer Rights herein.

Membership Card and FOB:
All members will receive a free membership card – bar code. If a membership card is lost or stolen, the member must notify the Club immediately.

All members can purchase a FOB for our electronic FOB entrance at a cost. If lost, members must nifty the Club immediately and another one will be issued for a fee.

Misuse of a membership card/fob or permitting another person to use the card shall be a cause for termination of membership without a refund.

Notice of Consumer Rights

Day Passes Terms and Conditions:

  • Guests may visit as often as they would like upon paying applicable day fees for gyM Pass.
  • Day passes purchased in advance must be used within one week of purchase.
  • Guests must be at least 16 years old to enter the club
  • Photo ID required for all guests.
  • All guests must follow The Mine Code of Conduct.
  • There is no refund for a day pass or guest pass.

Class Packages Policy:
For 5 and 10 class packs, for the 4 studios (BARRE, YOGA, RIDE +, YARD) and access to the Open gyM, there is 90-day expiration. For the 5 class packs for FORM Studio only + access to Open gyM, there is a 45-day expiration date, while the 10-class pack has a 90-day expiration date.

*There are no refunds for class packages.

Studio Cancelations and No Shows
You must cancel class up to 2 hours in advance for no fee. If you cancel within 2 hours, you will lose your class credit. No shows will be charged a $25 fee. No exceptions.

Limitation of Liability:
By creating an account and/or attending classes, events, services, activities and other programs and using The Mine club facilities and equipment, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in the strenuous nature of The Mine services. You hereby acknowledge that you have voluntarily chosen to participate in an intense physical exercise program. You understand that The Mine strongly recommends that you consult with your physician prior to commencing any classes. By signing this document, you acknowledge that you have been fully informed of the strenuous nature of these group fitness classes and the possibility of adverse physiological occurrences including, but not limited to: abnormal blood pressure, fainting, heart attack or death. You assume all risk for your health and well-being, and fully release and hold harmless for any responsibility, cost or damages of The Mine, its instructors, members and employees. You hereby acknowledge that you, and any minor under your care, fully release.  In consideration for being permitted to sign up for, access and/or attend classes, gym access, amenities, events, activities, and other programs (individually and/or collectively, the “Services”) and for using the premises, facilities and equipment (individually and/or collectively, the “Club”) of The Mine, you hereby acknowledge and agree to, on your own behalf, and on behalf of your personal representatives, heirs, assigns, executors, administrators, and next of kin, as follows: You are aware and acknowledge that there are certain inherent risks and dangers associated with fitness, exercise equipment and general equipment used in the Services and the Club, whether caused by you or not. You are aware and acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries and understand and agree that The Mine provides the Club “as is” and disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. Upon entering The Mine, you will inspect The Mine and your observation and use of the same shall constitute an acknowledgment that you find and accept such premises to be safe and reasonably suited for their intended purpose(s). If you do find any unsafe or unreasonably suited conditions with this location you will immediately cease to continue with any activity and will immediately notify an employee of The Mine of the unsafe or unreasonable suited conditions. You assume the risk of any and all accidents or injuries of any kind that may be sustained by, or in connection with, use of the premises of The Mine and agree to use care in the use of The Mine to protect against accidents to and by other participants. You are aware and acknowledge that the specific risks vary from one activity to another, but range from (i) minor injuries such as scratches, bruises, sprains and breaks; (ii) major injuries such as eye injury or loss of sight, hearing injury or loss of hearing, joint or back injuries, heart attacks, and concussions; and (iii) catastrophic injuries including paralysis and death. You understand that The Mine shall have no responsibility to pay for medical treatment and related costs if you are injured. At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to me by staff of The Mine. You are aware and acknowledge that you should consult with your physician or have a physical examination before participating in Services at The Mine or enrolling in any Services at The Mine, especially if you have a history of heart disease, high blood pressure or other chronic illness, or are unaccustomed to physical exertion or have other physical limitations. If in the subjective opinion of The Mine’s staff, you would be at physical risk participating in Services, you understand and agree that you may be denied access to the Services until you furnish The Mine with an opinion letter from your medical doctor, at your sole cost and expense, specifically addressing the concerns of The Mine and stating that the concerns of The Mine are unfounded and without medical merit. You agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Services and Club; release, indemnify, and hold harmless of The Mine , as well as subsidiary affiliate entities, and each of their respective officers, directors, shareholders, members, employees, representatives and agents, and each of their respective successors and assigns and all others, from and against any and all liability, responsibility, claims, actions, suits, procedures, costs, expenses, damages, injuries, expense, demand or cause of action that you may suffer whether with respect to personal injury, death, damage to or destruction of property, theft or otherwise that may arise out of or in any way be related to participation in the Services or use of The Mine’s Club; and represent that you: (a) have no medical or physical condition that would prevent you from properly using any of The Mine’s Services, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise such as that offered by The Mine you are aware and acknowledge that if you have any chronic disabilities or conditions, you are at risk in using The Mine’s Services and Club, and should not be participating in any Services which could cause increased risk of injury or adverse health consequences as a result of exercise. You are aware and acknowledge The Mine makes no claims as to medical results that can or may be obtained through participation in Services and use of The Mine. The Mine has neither suggested nor will suggest any medical treatment to you. Only licensed medical professionals are qualified to give medical advice. You are instructed not to act on the advice given by any unlicensed employee of The Mine unless such advice has been verified by participant’s licensed physician. You further understand and acknowledge that The Mine does not manufacture fitness or other equipment or products available in The Mine’s club and therefore The Mine will not be held liable for defective equipment or products. Accordingly, to the fullest extent permitted by law, you do hereby forever release, waive and discharge The Mine from any and all claims, demands, injuries, damages, actions or causes of action (collectively, “Claims”) related to my participation in Services and use of the Club against The Mine, or anyone acting on their behalf, and hereby agree to defend, indemnify and hold harmless The Mine from and against any such Claims.
